1.1 Merchandising & Pricing Policy

All items on this website and published catalogues have been included in good faith on the reasonable expectation that goods described will be available for the duration of the promotion advertised at participating stores. If an item is unavailable for any reason, a store may offer a rain check for the item at the advertised price or may nominate equivalent goods, unless the item is advertised as “no rain check”.

SportsPower stores are independently owned and operated businesses. Not all items are available at all stores, and items will only be available at the advertised price until sold out. Prices, availability and specifications are subject to change without notice by each individual store.

A store reserves the right to limit purchases to reasonable retail quantities. Styles, specifications, sizes and colours featured may vary from store to store. Advertised savings, discounts or “was” prices relate to recommended retail prices (RRP). Individual stores have no obligation to comply with the RRP. Therefore advertised savings may differ from actual savings if your store has been offering the item for less than the RRP.

Unless otherwise specified, display accessories shown are not included. Some items may require assembly. Delivery charges to customer are not included and may be charged if delivery is required.


1.2 Lay-By Policy

By law, our Lay-By contract must be in writing and must include details such as:

  1. A full description of the goods being purchased.
  2. The total price of the goods.
  3. The amount of deposit paid and the amount of the outstanding balance.
  4. When additional payments are due, for example weekly, monthly, etc.
  5. If any cancellation fees apply and how they are calculated.
  6. The stores details, name and street address, and any other terms or conditions.

Can a Purchaser Terminate a Lay-By?

  1. You may terminate a Lay-By agreement before the goods are delivered or if they are damaged when you receive them.
  2. You should remember that you may have to pay a termination charge if you simply change your mind.
  3. A termination form that complies with the laws is available from this store, if required.

Can we Terminate your Lay-By?

If you fail to meet the requirements of the Lay-By contract, the store may terminate the agreement. We must firstly:

  1. Send you a notice advising how you have failed to meet the requirements of the contract.
  2. Give you 14 days to meet them.

If you still don’t meet the requirements, we may:

  1. Terminate the Lay-By agreement.
  2. Charge the agreed termination charge and deduct it from the refund of any monies already paid.
  3. Refund the balance to you within 14 days.

*Our stores may also terminate the Lay-By agreement if the goods to which the agreement relates are no longer available. In that case, you will be notified accordingly and refunded any monies already paid within 14 days.


1.3 Privacy Policy

SportsPower is committed to providing you with the best possible customer service experience. SportsPower is bound by the Privacy Act 1988 (Crh), which sets out a number of principles concerning the privacy of individuals.

Collection of your personal information

There are many aspects of the site which can be viewed without providing personal information, however, for access to future SportsPower customer support features you are required to submit personally identifiable information. This may include but not limited to a unique username and password, or provide sensitive information in the recovery of your lost password.

Sharing of your personal information

We may occasionally hire other companies to provide services on our behalf, including but not limited to handling customer support enquiries, processing transactions or customer freight shipping. Those companies will be permitted to obtain only the personal information they need to deliver the service.SportsPower takes reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

Use of your personal information

For each visitor to reach the site, we expressively collect the following non-personally identifiable information, including but not limited to browser type, version and language, operating system, pages viewed while browsing the Site, page access times and referring website address. This collected information is used solely internally for the purpose of gauging visitor traffic, trends and delivering personalized content to you while you are at this Site.

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will use for these new purposes only, data collected from the time of the policy change forward will adhere to our updated practices.

SportsPower reserves the right to make amendments to this Privacy Policy at any time. If you have objections to the Privacy Policy, you should not access or use the Site.

Accessing Your Personal Information

You have a right to access your personal information, subject to exceptions allowed by law. If you would like to do so, please let us know. You may be required to put your request in writing for security reasons.SportsPower reserves the right to charge a fee for searching for, and providing access to, your information on a per request basis.

Transactions on our website

There is always a risk in transmitting your personal information via the Internet. To make sure you are accessing via a secure server, please check for the unbroken key or closed lock symbol generally located either at the bottom left or top right of your browser window. You can also check this by looking at the URL. If the URL is secure, then the first characters will read ‘https’ rather than just ‘http’. We are compliant with the Payment Card Industry Data Security Standard (PCI DSS) which is an information security standard for organisations that handle credit card data. This means that your credit card details will be handled using secure processes when you shop with us online and in-store. However, please do not enter any credit card details when contacting us via email or through our website “Contact Us” form. Credit card details will not be encrypted in these situations and will not be secure.

1.4 Returns & Exchanges Policy

SportsPower Australia encourages you to select carefully while shopping online as we do not offer refunds or exchanges for changes of mind.

If the product you ordered does not fit you may return the product to our Docklands Store along with your receipt that was received with the order. You will be required to pay for any costs associated with returning the product to SportsPower Docklands (Melbourne) and will be charged a subsequent shipping fee for the replacement product to be sent to you.

If we have shipped the wrong product for your online order simply contact us, and we will arrange for the correct products to be sent to you and the incorrect products to be returned to us.

Important: SportsPower stores around Australia are independently owned and operated and are under no obligation to provide you with an exchange or refund for product you have ordered via www.sportspower.com.au. Returns to physical stores and stores other than the original place of purchase are at the discretion of the individual store’s manager or owner. Also note that the range in each SportsPower store will vary from store to store and the item you have purchased online may not be available. You should contact SportsPower Docklands (details above) for any order queries or issues you may have.


1.5 Faulty Good Policy

If you feel that the goods you purchased from www.sportspower.com.au are faulty we will meet our obligations in accordance with your rights as a customer under the Consumer Guarantees Act and the Fair Trading Act. This policy only applies to footwear, apparel (excluding underwear, thermals, swimwear and socks) and small sports equipment and accessory items normally stocked by the majority of SportsPower stores and on www.sportspower.com.au.

Sportspower will accept product returns and if applicable under the act, provide you with an exchange, credit note, refund or repair where:

  1. The product is not of acceptable quality in accordance with the Consumer Guarantees Act
  2. The product is not fit for its intended purpose, or
  3. The product does not match the sample or our description; and
  4. You produce your original SportsPower receipt at the time you return the item

They may need to assess your product to determine whether a repair, replacement or refund is appropriate.

Certain products may need to be sent to the manufacturer or their repair agent for assessment, such as:

  • cricket bats, tennis racquets and similar items;
  • heart rate monitors and other electrical or technological products;
  • clothing, compression garments, some footwear; or
  • bulky goods such as treadmills, exercise bikes, home gyms.

For some product assessments you may have the option to liaise directly with the manufacturer or their repair agent. Our online store manager can provide you with the relevant manufacturer contact details in this case.

Please allow up to two weeks for assessment of your product to take place. In cases where the product needs to be referred to the manufacturer this process may take longer.

Any expenses relating to the return of your product to our online store will have to be paid by you.
